1. Agreement to Terms

By accessing or using the services of Clinton Personal Training ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

2. Services Provided

Clinton Personal Training offers the following services:

  • One-to-one personal training sessions
  • Online coaching and programming
  • VO₂ Max testing and assessment
  • Resting Metabolic Rate (RMR) testing
  • Nutrition guidance and programming
  • Performance coaching and consultations

3. Booking and Payment

3.1 Booking Process

Services must be booked in advance through our website, WhatsApp, or email. Bookings are confirmed upon receipt of payment.

3.2 Payment Terms

  • Payment is required at the time of booking unless otherwise agreed
  • We accept payments via Stripe, Apple Pay, and bank transfer
  • All prices are in British Pounds (GBP) and include VAT where applicable
  • Package prices are valid for the duration specified at time of purchase

3.3 Package Validity

Training packages must be used within the specified timeframe (typically 3-12 months from purchase date). Extensions may be granted in exceptional circumstances at our discretion.

4. Cancellation and Refund Policy

4.1 Client Cancellations

  • 24+ hours notice: Full credit or refund
  • Less than 24 hours: No refund or credit (session forfeited)
  • No show: No refund or credit (session forfeited)

4.2 Service Provider Cancellations

If we must cancel a session, you will receive full credit or the option to reschedule at no additional cost.

4.3 Package Refunds

Unused sessions from packages may be refunded pro-rata within 14 days of purchase. After 14 days, refunds are at our discretion and subject to a 20% administration fee.

5. Health and Safety

5.1 Medical Clearance

You must disclose any medical conditions, injuries, or health concerns before starting any training programme. You should consult with your GP before beginning any new exercise programme, particularly if you:

  • Have a history of heart problems or cardiovascular disease
  • Have diabetes or metabolic conditions
  • Are pregnant or recently gave birth
  • Have any chronic illness or take regular medication
  • Have experienced chest pain during physical activity

5.2 Physiological Testing

VO₂ Max and RMR testing involve physical exertion and measurement. By participating, you confirm that:

  • You are in sufficient health to undertake the test
  • You have completed the required health questionnaire honestly
  • You will inform us immediately if you experience discomfort during testing
  • You accept the inherent risks associated with maximal exercise testing

6. Liability and Disclaimer

6.1 Assumption of Risk

You acknowledge that physical exercise and training carry inherent risks of injury. You voluntarily assume these risks and agree to participate at your own risk.

6.2 Limitation of Liability

To the extent permitted by law, Clinton Personal Training shall not be liable for any injury, loss, or damage arising from your use of our services, except where caused by our negligence or wilful misconduct.

6.3 Insurance

We maintain professional indemnity and public liability insurance. You are responsible for maintaining your own personal accident and health insurance.

8. Client Responsibilities

As a client, you agree to:

  • Provide accurate health and medical information
  • Follow instructions and guidance provided during sessions
  • Notify us immediately of any health changes or concerns
  • Arrive on time for scheduled sessions
  • Treat our facilities, equipment, and staff with respect
  • Maintain appropriate personal hygiene and wear suitable clothing

9. Intellectual Property

All content, training programmes, materials, and intellectual property provided remain the property of Clinton Personal Training. You may not reproduce, distribute, or share this content without written permission.

10. Privacy and Data Protection

Your personal and health information is processed in accordance with UK GDPR and our Privacy Policy.

11. Photography and Media

We may photograph or film sessions for promotional purposes. We will obtain your explicit consent before using any images or videos featuring you. You may withdraw consent at any time.

12. Termination

We reserve the right to terminate services if you:

  • Breach these terms and conditions
  • Behave inappropriately or disrespectfully
  • Provide false information about your health
  • Fail to make payment

13. Changes to Terms

We may update these Terms and Conditions from time to time. Continued use of our services after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
